Total d-bag out for himself. The track day org didn't even put the bags out, the track did for erosion control.
So if the crash line had a steel barb sticking out of the ground, and you were impaled after a crash, then would you still shrug it off as "it's expected"? I don't blame the guy who crashed for suing. He broke both legs as a direct result of the sandbag placement. He could have been paralyzed with the way he flipped around and crashed. It's unfortunate that the liability is on the organization because it's up to them to inspect the track beforehand to address any safety concerns.

I will agree that Kim suing for 7.5 million is a bit overkill. It's definitely not about safety for this guy, it's about the payout. He even throws in some shameless plugs for his company's products during interviews about the crash.

Agreed. While he may not be completely blameless, by missing the brifing and whatnot. The fact remains the bag made the accident 10 times worse. Him suing for more than the insurance cover is a pure d**k move on his part.

Don't shoot the messenger please, I thought this article provides some slightly different perspectives:

Daniel is a pxxxy who didn't attend the riders meeting where the sand bags were called out. He had more important **** to do and like most riders who miss the meetings, didnt want to waste his time with it, because he already knows everything. First lap and session out is a survey lap to scan for anything od concern. The fact that he blamed the track for his injuries from sandbags used for flash flooding is complete horseshit. Hes lucky to have only broken legs. Worse injuries have happened on 300 feet of grass runoff.

Pretty sure it was the Laguna lawsuit that made it impossible for Keigwins to get insurance.

On the basis he tried to sue Laguna first he's probably barred from the track for life now. It's sad that Keigwin's is going away. But Carter's at the Track is starting up to replace it.

Well, the good thing is, that mayby now all track day organisers are willing to remove sandbags, big stones and landmines from safety zones. And that is a good thing.

Also it was a good thing that the rider did not slide in to sand bags. Because at those speeds, they are almost the same as stones.

For novice track day riders a typical crash is panic mode for some reason, and then they drive in to the safety zone.
For experienced track day riders a typical crash is low sider (front brake) just before apex. And then you slide...
So it was also a good thing that the rider was a novice.
